-insists that the law provides for Technocrat MinistersPresident David Granger has described as “regrettable” the move by outgoing Chief Justice (Ag) Ian Chang toPresident David Granger speaking to media operatives yesterday.rule in favour of the People’s Progressive Party (PPP) that Minister of Citizenship, Winston Felix and Minister within the Ministry of Social Protection, Keith Scott, cannot sit in the National Assembly as technocrats.The move, though not illegal, has been deemed unorthodox by some individuals since it required Chang taking a break from his pre-retirement leave to make the ruling.Chang ruled that by virtue of their status as elected members of the National Assembly, Felix and Scott cannot sit in Parliament as Technocrat Ministers.But according to President Granger, yesterday, Government will challenge the ruling of the acting Chief Justice.  He said, “It is rather regrettable that the Chief Justice would come out of his leave to issue such an order.”Although unable to speak precisely on the status of Government’s legal challenge, President Granger speculated yesterday that proceedings ought to have been filed by now by Attorney General, Basil Williams.In the interim, though, President Granger said that Government will abide by Chang’s ruling. “We had consultations and Speaker of the National Assembly,Bryan Bickell Jersey, (Barton Scotland) is aware of our views, but we will operate within the law.”Convinced that Government is within its right to challenge the ruling, the Head of State stressed, “We are convinced that we are correct… There is precedent; there have been many from 1966. There have been Technocrat Ministers; the law provides for it and I was very astonished at Justice Chang’s ruling but we will challenge the ruling and you will hear from us,” President Granger said.The PPP had objected to the appointment of Felix and Scott as Technocrat (expert or skilled in their field) Members of the National Assembly following the APNU+AFC ascension to office after the May 11, 2015 General and Regional Elections.The party, via a statement, had contended that “Articles 103 (3) and 105 of the Constitution and Laws pronouncing on the eligibility of appointment of Technocrat Ministers, do not confer Technocrat status on these persons already sworn in by President Granger as Ministers.”The matter was filed by PPP member, Desmond Morian. The application cited Articles 60, 103, 105, 160 and 232 of the Constitution of the Cooperative Republic of Guyana, Chapter 1:01.He contended that the names of the two Ministers were not extracted from the coalition’s list of candidates hence they did not fit the criteria for the positions.Morian essentially sought a declaration from the court barring the two members of Government from sitting in the National Assembly as Technocrat Ministers.The applicant was represented by Attorney at Law, Anil Nandlall. Attorney General, Mr. Basil Williams, and the Speaker of the National Assembly, Dr. Barton Scotland, were named as respondents.In the 15-page ruling, the Chief Justice outlined that the Court sees it fit to grant Morian the application on the basis that Felix and Scott are elected members of the National Assembly but despite that status, they do not hold seats and cannot sit in Parliament as Technocrat Ministers since their names were not extracted from the APNU /AFC list of successful candidates.Additionally, Chang granted a declaration that Article 105 of the Constitution has no application to elected members of the National Assembly, that is, persons whose names were on the successful list of candidates.Chang also noted that despite their appointment by the President to be executive members of the Government, such an executive appointment does not entitle Felix and Scott to hold seats or sit as Technocrat Ministers.Morian and his Attorney, Nandlall, were present at the hearing. Attorney Prithima Kissoon appeared on behalf of the Attorney General.In an invited commented Nandlall asserted that the ruling represents the incompetence of the present administration.
