| A Partnership for National Unity (APNU) has informed that leave was yesterday granted for an appeal of Chief Justice Ian Chang’s decision to remove Opposition Leader, Brigadier (ret’d) David Granger, as a party in the recently concluded Budget cut case.A statement from the Party said that Attorney Basil Williams, who is representing Granger, appeared before Justice James Bovell-Drakes and Justice Rishi Persaud and was granted leave for an appeal to the Appellate Court following a short hearing.This application to the Court of Appeal for leave came after the Full Court ruled that it had no jurisdiction to hear Granger’s dismissal matter. Granger was excluded from the Budget cut case which was brought on by the Government side of the House of Assembly because according to the Chief Justice,NFL Jerseys China, he has parliamentary immunity.Finance Minister Ashni Singh was also dismissed from the case on the same grounds. Speaker of the National Assembly Raphael Trotman remained a defendant in the matter, since it was claimed that he opened the door for the combined Opposition to cut the Government’s 2012 Budget.The Budget cut case concluded earlier this year in favour of the Government. The Chief Justice identified several areas of the Constitution which he interpreted as meaning that the Opposition could not cut the Budget, but could approve or disapprove parts.The Opposition has stated however that it plans to appeal the ruling since they claim that the House of Parliament which is governed by its own rules allows them to do so. The Opposition has stated also that they are prepared to take the matter to the Caribbean Court of Justice if deemed necessary. |
